Jetysu Region's Administrative Court Reviews Complaint Over Land Allotment Delay

Kazakh Court Overturns Unfair Land Allocation After 19-Year Wait

The Administrative Court of Jetysu Region has reviewed an appeal from a resident identified only as T., who has been attempting to obtain a land plot for home construction, reports our website.

Earlier, a lower court dismissed her lawsuit against the akimat (local administration) of Yerkinsky Rural District in Taldykorgan. The woman had sought to have the akimat's actions declared unlawful and to reassess her place in the queue for land.

Dissatisfied with the ruling, she filed an appeal, arguing that the queue had barely moved despite plots being allocated in the district.

The court found that the plaintiff had been on the waiting list since 2006, initially holding position No. 2,325. By 2008, her number had improved to 1,759, and by 2025, it reached 1,751—meaning the queue had advanced by just a few spots over nearly 17 years.

However, it emerged that during one period alone, over 400 residential land plots were distributed in the district. Under normal circumstances, the queue should have progressed far more significantly.

The local authority failed to provide a clear explanation for the minimal movement in the queue or how the electronic waiting list was compiled.

The appellate court ruled that the akimat's actions were unlawful. It ordered the restoration of the plaintiff's rights and a recalculation of her position in the queue, accounting for its actual progression since she first registered in 2006.

The decision has entered into legal force.

Earlier reports indicated that Kazakhstan had introduced a transparent system for tracking housing applicants.
